If the claim resolves before a lawsuit is filed.
Utah Injury Claims · Fees
No retainer and no hourly bill. The fee is a share of what is recovered, and there is no fee at all if nothing is recovered.
The short answer
Injury and wrongful death matters are taken on contingency. You pay no retainer, and the fee is a percentage of what is recovered. If there is no recovery, there is no attorney fee.
The fee
If the claim resolves before a lawsuit is filed.
Once suit is filed.
If the case is appealed.
The percentage steps up because the work does. A claim settled on a demand package is a different undertaking from one tried to a verdict and defended on appeal.
Case costs are separate from the fee. Records, filing fees, deposition transcripts and expert witnesses are advanced by the firm and deducted from the recovery after the fee is calculated. The full terms are set out in writing before you sign anything.
What it means in practice
A contingency fee puts the firm's money on the same side as yours: we are paid out of a recovery, so a claim that recovers nothing costs you nothing and costs us the work.
It also means we will tell you when a claim is not worth bringing, and when it is small enough that you should keep all of it rather than share a third. A case review costs nothing and that answer is part of it.
