Utah Injury Claims · Case Value

What is my Utah car accident case worth?

There is no honest number before your treatment ends. There is a structure, and knowing it tells you what your claim will turn on.

The short answer

No one can value your claim before your treatment ends

Any figure produced before you finish care is a guess about medical records that do not exist yet. An online calculator multiplying your bills by three is selling certainty nobody has.

What can be described honestly is the structure. A Utah motor vehicle claim is built out of four things, and each of them moves independently.

The components

What a Utah claim is actually made of

Medical expenses

The reasonable value of the care you needed. PIP pays the first tranche, and what remains is claimed against the at-fault driver.

Lost income

Wages and earning capacity you lost. PIP covers the lesser of $250 per week or 85% of gross income for up to 52 weeks; a larger loss goes on the liability claim.

General damages

Pain, suffering, and loss of enjoyment. Available only once the claim crosses the threshold in U.C.A. § 31A-22-309(1)(a).

Future care and impairment

Treatment you will still need, and permanent impairment documented on objective findings. This is usually the largest component in a serious case and the one most often left out.

The threshold is explained in full on Utah's no-fault rule and the $3,000 threshold.

The limits

Three things that cap a claim regardless of injury

Insurance limits

Most claims are paid by a policy, and the policy has a number on it. Utah's minimum liability limits are low, so the available coverage, rather than the injury, frequently sets the ceiling.

Your share of fault

Recovery is reduced by the percentage of fault allocated to you, and eliminated once your share reaches half, under U.C.A. § 78B-5-818.

Liens and reimbursement

Health insurers, medical providers and your PIP carrier may have claims against the recovery. What you keep is what remains after those are resolved.

What to do instead

Finish treating, then value it

The practical answer is to complete your care, or reach the point where a physician can say what is permanent, and value the claim against a finished record. An insurer that is pressing for a decision before then is asking you to price something neither of you can see.

We will tell you what a claim looks like worth once the records support a number, and we will tell you when it is small enough that you should keep all of it.
